UPDATE ON PLB DAYS

As you know, the recent Appellate Court decision found that the Civil Service Rule eliminating carryover of PLB days beyond June 30, 2012 violated the 2009 MOA.

We have been informed that the Civil Service Commission intends to adopt a new rule to force workers to use their PLB days by June 30, 2012.

We are going to take whatever actions are necessary to contest this rule in Court. However, it is possible that we will not resolve this matter by June 30, 2012.

We are therefore recommending that our members who do not want to use their PLB days do the following:

1.Wait and schedule their days as close to June 30 as possible
2. Submit with their request for the days, the following memo:
"I am requesting the use of my PLB days only because I do not want to lose them. I believe that the MOA permits me to carry over these days indefinitely. Please be advised that if and when there is a determination that I was able to carry over my PLB days, I will want to be credited with the days I was coerced into using."

We are investigating what is the best course to take and we will know before the end of the fiscal year what our situation is. We strongly recommend that you follow the instructions above so that you are protected.
